    At his State of the Union Address earlier this year, President Obama announced the formation of the President’s Commission on Election Administration, which was charged with exploring options to promote the efficient administration of federal elections and to improve the voting experience.  The Commission has held a number of public meetings and hearings throughout the country over the past several months, and G.A.B. Director and General Counsel Kevin Kennedy has been invited to provide testimony to the Commission at a meeting in Cincinnati later this month.

    Director and General Counsel Kevin Kennedy testified today before the Senate Committee on Elections and Urban Affairs on several bills related to election administration issues: Senate Bills 20, 262, 264, 265, 267 and 268.  For your information, Director Kennedy’s prepared testimony is attached.  His spoken testimony was more extemporaneous, and there was a good discussion with the committee members regarding election administration issues that are important to clerks.  You may watch a recording of the hearing on Wisconsin Eye:

    The Wisconsin Election Administration Council will be meeting at 11 a.m. on Thursday, September 19 in Ozaukee County to view a demonstration of two pieces of Dominion Voting Systems software and equipment:

    • Ballot Station 4.6.4D Software for AccuVote-TSX (Touchscreen Voting System)
    • New Memory Card for AccuVote-OS (Optical Scanner)

    There will be a separate public demonstration of the equipment at 5 p.m.

    An electronic poll book, also referred to as an e-poll book, is the computer equipment, program or a combination of the two that replaces a paper-based poll book.  E-poll books allow election officials to review and/or process voter information during an election but do not actually count votes.  An e-poll book can do everything that a paper poll book does.  E-poll books may also allow clerks to record voter participation in SVRS, enter Election Day registrations and redirect voters to the correct polling location.

    Several clerks have contacted our office regarding a request that is being sent to Wisconsin municipalities seeking information about voting equipment memory devices and the data that may be available from those devices.  As we have previously indicated, we cannot provide legal advice regarding compliance with the Public Records Law, and we encourage clerks to consult with their municipal attorneys in responding to records request.  It may be helpful, however, to review the information we circulated in 2012 pertaining to requests for memory device data.

    In response to discussions with the Task Force on Clerks Workload Concerns, the Government Accountability Board and staff have made some changes to election cost reporting procedures. Thank you to all of the clerks who provided valuable input into the initial design and feedback on the draft versions of the GAB-191 Election-Specific Cost Report and the GAB-192 Annual Election Costs Report. We firmly believe that involving clerks throughout any change process produces the best results, and this is an excellent example of quality results produced by continuous clerk involvement.

    Based on county and municipal clerk responses to the 2013 Election Administration and SVRS Training Survey posted several months ago, Board staff has developed an SVRS training schedule in preparation for the spring 2014 elections.  Clerks new to SVRS are required to take the 2-day beginning Application, Election Management and HAVA Interfaces training class to be fully certified to work in the system.  Absentee Process training is optional and consists of a full day of training with a hands-on workshop in the afternoon.

    One unique challenge of completing related tasks to the Spring Election in Wisconsin is the potential closing of governmental offices due to severe winter weather.  The deadline for local candidates to file nomination papers with their filing officers is 5 p.m. on Tuesday, January 7, 2014.  The G.A.B. has received several inquiries regarding the upcoming weather forecast in some parts of Wisconsin and the possibility that local governmental offices, especially school districts, may be closed.

    Background

    2013 Wisconsin Act 160, formerly Assembly Bill 420, has been signed into law and is now effective for all petitions and nomination papers whose initial circulation date is on or after March 29, 2014.  Act 160 requires all nomination papers and other petitions to contain a space for the signer to legibly print his or her name.  In order for a signature to be considered valid, the signer must legibly print his or her name in addition to the other requirements of Wisconsin law.

    This memorandum provides an update regarding the status of the requirement that most Wisconsin voters provide an acceptable form of photo identification before receiving a ballot.  The photo ID requirement was established as part of 2011 Act 23 but its implementation has been enjoined by a state court injunction since the 2012 Spring Primary.  Two federal court cases have also been pending.  On April 29, 2014, U.S. District Court Judge Lynn Adelman issued a decision in the two federal court cases which found that the photo ID requirement of Act 23 violates the U.S.

    The G.A.B. now offers BADGER Voters, (http://BADGERVoters.gab.wi.gov), a website designed to allow users to request, generate a price quote for, purchase, and download Wisconsin voter registration and election participation data from the Statewide Voter Registration System (SVRS).  Users can complete this entire process online and independently 24 hours per day, seven days per week.

    As you know, new legislation requires the endorsement section of a ballot to include an area for identifying and recording remade ballots.  The wording of the legislation is quite simple in that it requires a place to identify an over voted or damaged ballot and record a serial number.  Discussion among staff and management determined that the terms “over voted” and “damaged” do not adequately cover the reasons for remaking a ballot.

    State and federal law require that voting occur in an open and accessible manner.  In 2006, all municipalities were required to purchase an accessible voting system that provides individuals with disabilities the opportunity to vote privately and independently.  In order to comply with this mandate, municipalities were eligible for reimbursement towards the purchase, programming and maintenance of an accessible voting system for up to $6,000 in funding for each polling place established by 2005.

    Due to the apparent confusion regarding which inspectors should be sealing the ballot bag and signing the GAB-101 Ballot Container Certificate, a revised GAB-101 has been posted to the G.A.B. website http://www.gab.wi.gov/forms/gab-101,
     
    The revised GAB-101 contains an explanation of “affiliated” and “unaffiliated” inspectors, and details which inspector should be sealing and signing the ballot bag with the Chief Inspector.

    Please note this guidance:  If a voter has not selected a party preference, casts votes on one political party’s ballot, then writes in on that same party ballot the name of a person whose name appears on a different party ballot, the write-in vote is not counted but the remaining votes are counted.  The ballot is treated the same as if the voter had marked a party preference.

    Many counties are potentially involved in recount processes from the August Partisan Primary.  The G.A.B. understands this requires additional clerk resources and attention.  Our goal is to remain sensitive to these increased demands on some clerks, while also encouraging some SVRS election setup tasks be completed now.  These steps will be beneficial in meeting the September 18 deadline for absentee ballots to be sent to voters with absentee requests on file.

    Based on county and municipal clerk responses to the 2014 Election Administration and SVRS training survey posted after the April election, Board staff has scheduled additional SVRS training schedule in preparation for the November election.  Clerks new to SVRS are required to take the 2-day beginning Application, Election Management and HAVA Interfaces training class to be fully certified to work in the system.  Absentee Process training is optional and consists of a full day of training with a hands-on workshop in the afternoon.

    This afternoon the Seventh Circuit Court of Appeals reinstated the requirement that most Wisconsin voters present photo identification in order to cast a ballot for the November 4, 2014 General Election.  The Court of Appeals lifted an injunction against the requirement that had previously been issued by Judge Lynn Adelman of the Eastern District of Wisconsin federal court.  A copy of the Court of Appeals order is attached.
